Clay County Courthouse Electronic Devices Policy

Effective September 11, 2025 the Clay County Courthouse has adopted the following Portable Electronic Device Policy.

Policy

Only authorized persons are permitted to possess any Portable Electronic Device inside the Clay County Courthouse.

Purpose

The Sheriff recognize that is a urgent need to restrict the possession of “Portable Electronic Devices” (PEDs) in the Clay County Courthouse. It is also recognized that inappropriate use of Portable Electronic Devices in courthouses can be a danger, cause distractions, and impact the orderly administration of justice. Legitimate security concerns exist from the possible misuse of Portable Electronic Devices, including the unauthorized creation of photographs; video and audio recordings which can be posted on social media or in other public forums; unauthorized communication with jurors or witnesses; and threats and intimidation directed toward parties, witnesses, jurors, or others. Additionally, the misuse of Portable Electronic Devices can cause either intentional or unintentional disruptions in the order and processes of the courts. The policy accepts the need to maintain security, safety, and order in Illinois courts while balancing the need for access.

Definitions

Portable Electronic Devices Restrictions– “Portable Electronic Devices” (PEDs) are mobile devices capable of electronically storing, accessing, or transmitting information and is defined to include personal computers, tablet computers, mobile telephones (including cell phones, electronic device and any form of telephone with cameras and audio and video recording and transmission capabilities), electronic calendars, e-book readers, smartwatches, or similar devices

Authorized Person- Any county employee, officer of the court, county board member, members of the press covering county board meetings, any person with prior approval from an office holder or court security.

All Portable Electronic Devices must be turned off or placed in “silent” mode at all times within the courthouse

Anyone found to be violating this policy may be removed from the courthouse and subject to other penalties or sanctions under the law. A PED may be confiscated and held until the possessor leaves the courthouse or longer depending on the violation. Courthouse personnel shall not be responsible or liable for any damage to or loss of any item.

Resident Judge Joel Powless has entered Administrative Order 2025-1 that establishes a policy on Portable Electronic Devices possession and use in the courtroom.
